1. Title of the event / trade fair

2. Date and venue of the event

The expopharm trade fair takes place annually, alternating between the cities of Düsseldorf and Munich, and is organized by Avoxa - Mediengruppe Deutscher Apotheker GmbH in cooperation with Messe Düsseldorf GmbH and Messe München GmbH.

Please note that the exact dates and locations of the expopharm trade fair are announced on the official website of the trade fair organizers.

4. Applicability of the trade fair regulations and the site rules and terms of use for the exhibition grounds

These trade fair regulations apply to visiting and staying at the trade fair in all areas of the exhibition grounds insofar as they are used for the duration of expopharm, i.e. including, among other things, the lecture area, the entrance and exit areas of the grounds, the outdoor area, and all buildings and land areas temporarily made available to Avoxa - Mediengruppe Deutscher Apotheker GmbH in connection with staging expopharm. Animals may only be brought along with prior approval. If permission is granted, the person bringing an animal must ensure that no danger or disadvantage arises for the organizer or third parties. Dogs must wear a muzzle. These regulations apply to all persons who enter or remain on the exhibition grounds in the above sense, whether authorized or unauthorized.

The site rules and terms of use for the exhibition grounds at the respective trade fair location, posted at the trade fair entrance or accessible via Messe Düsseldorf or Messe München, also apply additionally.

5. Participants, visitors

Access to the trade fair is reserved for natural persons from the following professional groups: pharmacists, pharmacy managers, physicians, pharmaceutical engineers, pharmacy technicians, pharmacy students, trainee pharmacists, members of other academic healthcare professions, healthcare professionals, healthcare marketers, as well as employees and representatives of participating partners and sponsors and persons invited by the organizer.

Regardless of this, every natural person present on the exhibition grounds, whether on the basis of a contract with the organizer as an exhibitor, co-exhibitor, partner, or visitor, as a service provider or contractor of the organizer or an exhibitor/co-exhibitor, or on the basis of a right of access granted by the organizer (press, politics, etc.), must observe these terms and conditions of participation.

The proof of admission granting access, such as the trade fair ticket, exhibitor pass, or other proof of access authorization, must be retained for the duration of the trade fair visit and presented on request.

6. Right to issue instructions

During the event, the organizer shall exercise the right to issue instructions, if necessary jointly with or through third parties, and shall be entitled to give corresponding directions. The organizer may exclude a participant from the event in whole or in part if the participant disrupts the event and does not cease the disruption even after being threatened with exclusion.

7. Application of the protection and hygiene concept

During the event period, expopharm will take place under strict application of the currently applicable legal regulations on hygiene and infection prevention.

8. Access restrictions, checks

The organizer is entitled to regulate access to the event restrictively, for example by checking compliance with access conditions. The exhibition grounds and other event areas may only be entered with valid proof of admission, such as a trade fair ticket, exhibitor pass, or other access authorization. Proof of admission must be carried at all times and shown on request. Different access regulations, especially for exhibitors and companies working in the congress area, remain unaffected by this.

Persons found without valid proof of admission, who cannot demonstrate any other right of access, who refuse inspection, or who are otherwise present without authorization on the grounds used to conduct expopharm, must leave expopharm immediately.

Employees of the organizer or employees of security companies commissioned by the organizer who can identify themselves as such are entitled to carry out corresponding checks during expopharm and to apply suitable measures to implement and ensure compliance with the protection and hygiene concept. Participants only have access to the hall and outdoor areas during the opening hours of the event and must leave the hall and outdoor areas at the end of opening hours.

9. Exclusion of liability

The organizer shall only be liable for property damage in cases of intent or gross negligence on the part of the organizer, its vicarious agents, or its legal representatives.

In cases of slight negligence and breach of essential contractual obligations, liability is limited to foreseeable damage.

Regardless of fault, the organizer's liability remains unaffected in the event of fraudulent concealment of a defect or the assumption of a guarantee.

Personal liability of the organizer's legal representatives, vicarious agents, and employees for damage caused by slight negligence is excluded.

Any damage occurring must be reported immediately to the organizer and the trade fair service provider and, in the event of criminal acts, to the police, and must be reported in writing.

The organizer assumes no duty of care for items or goods brought along and excludes all liability for damage to or loss of such items. This exclusion of liability is not limited by any security measures taken by the organizer.

The exhibitor is also liable for damage to third parties arising when third parties act on behalf of the exhibitor, insofar as the third party is liable to the exhibitor or the organizer for such damage.

These limitations do not apply in cases of injury to life, body, or health, or in the event of a breach of cardinal obligations.

10. Prohibited, immoral, disruptive behavior, etc.

Any behavior on the exhibition grounds that is likely to disrupt the orderly conduct of the event, access to it, or the setup and dismantling of the event, or that otherwise conflicts with the interests of Avoxa - Mediengruppe Deutscher Apotheker GmbH, the German pharmacy profession, or other participants, visitors, and/or exhibitors, is prohibited, in particular, unless prior written consent of the organizer has been obtained:

  • any commercial or freelance activity during the event that has not been expressly approved in writing, especially the offering of items and services of any kind, whether for payment or free of charge;
  • any advertising activity whatsoever, such as distributing or displaying advertising of any kind, including on clothing, on the body, or on carried items, or posting flyers, advertising materials, posters, magazines, affixing stickers of any kind including on parts of buildings or other advertising media, approaching or addressing other visitors or exhibitors for advertising purposes, etc.

11. Photos and film/video recordings

Taking photographs, filming, making video recordings, drawing, painting, etc. for commercial purposes requires the prior written approval of Avoxa - Mediengruppe Deutscher Apotheker GmbH and, insofar as lecture areas, exhibition stands, exhibitors' or other third parties' products, or persons are concerned, also the prior written approval of the respective rights holder concerned. Avoxa - Mediengruppe Deutscher Apotheker GmbH is entitled to establish further rules in this respect.

During the event, photographs and film/video recordings will be made by Avoxa - Mediengruppe Deutscher Apotheker GmbH or by companies or persons commissioned by Avoxa - Mediengruppe Deutscher Apotheker GmbH to promote the event and for further public relations and external presentation of Avoxa - Mediengruppe Deutscher Apotheker GmbH. The photographs and film/video recordings may be published both on websites and in printed materials and other advertising media by Avoxa - Mediengruppe Deutscher Apotheker GmbH.

For the supplementary event offerings „pharma-world“ and „inspirationLAB“, companies commissioned by the organizer will make film recordings of the live discussion rounds including all persons involved and make them available to registered participants on the event website during the periods offered.

All persons entering or staying on the exhibition grounds used for expopharm are informed through these site rules that photo, film, and video recordings are being made in the area of the exhibition grounds used. By entering expopharm, visitors acknowledge this information and our further data protection provisions.

In addition, the photographs and film/video recordings may be processed by Avoxa - Mediengruppe Deutscher Apotheker GmbH on the basis of legitimate interest (promotion of the event, public relations, advertising). The legal basis for this is Art. 6 para. 1 lit. f GDPR. Further data protection information on this topic, including the controller and your rights, can be found in our privacy policy for the expopharm ticket shop.

Insofar as photographs, film, and/or video recordings are made in the area of the exhibition grounds used for expopharm by employees of Avoxa - Mediengruppe Deutscher Apotheker GmbH or by companies or persons commissioned by Avoxa - Mediengruppe Deutscher Apotheker GmbH for reporting or advertising purposes, such recording activity may not be obstructed or otherwise impaired.

Avoxa - Mediengruppe Deutscher Apotheker GmbH is entitled to regulate the operation of transmitting and receiving devices on the exhibition grounds on a restrictive basis.

12. Surveys, statistical studies

Surveys, statistical studies, and comparable activities and events require the prior written approval of Avoxa - Mediengruppe Deutscher Apotheker GmbH.

13. Restriction of transmitting and receiving devices

Avoxa - Mediengruppe Deutscher Apotheker GmbH is entitled to regulate the operation of transmitting and receiving devices on the congress grounds on a restrictive basis.

14. Video recording and television monitoring at entrances and exits

Avoxa - Mediengruppe Deutscher Apotheker GmbH is entitled to monitor the exhibition grounds and the entrance and exit areas by means of video recording and television monitoring. The participant consents to this.

15. Transport, carriage, or removal of exhibits and inventory

Exhibits, stand inventory, parts of stand fittings, and similar items may only be transported within the exhibition halls or removed from the exhibition grounds upon proof of authorization by presenting written confirmation from the owner/possessor. This applies in particular during opening hours.

16. Lost property

Items found within the exhibition grounds must be handed in at the exhibitors' office. Lost items can be collected there or the loss can be reported there.

17. Force majeure

In the event that access to expopharm cannot be granted, or can only be granted to a limited extent in terms of location and/or time, due to force majeure, which includes in particular restrictions in the event of a pandemic due to official orders/measures or preventive measures taken by Avoxa - Mediengruppe Deutscher Apotheker GmbH, access to expopharm may be denied or restricted, or the access authorization may be canceled by Avoxa - Mediengruppe Deutscher Apotheker GmbH. In these cases, the liability of Avoxa - Mediengruppe Deutscher Apotheker GmbH for breaches of duty for which it is responsible is limited to cases of gross negligence or intentional misconduct by Avoxa - Mediengruppe Deutscher Apotheker GmbH and/or its vicarious agents and assistants. These limitations do not apply in cases of injury to life, body, or health or in the event of a breach of cardinal obligations.

In all of the above cases, Avoxa - Mediengruppe Deutscher Apotheker GmbH is alternatively entitled to offer a livestream of the event, including at the event location, instead of access authorization to expopharm, without the respective contractual partner being entitled to derive from this any claim against Avoxa - Mediengruppe Deutscher Apotheker GmbH for reimbursement of the expopharm admission price or any other claims for damages.

Excluded from this are cases in which the contractual partner immediately applies for a refund and proves that they are unable to participate in the livestream for legitimate reasons.

18. NOTES:

a) to obtain timely information before traveling to expopharm about any entry/travel restrictions due to official orders/measures at the location of the respective expopharm; we endeavor to inform you promptly of any restrictions on the expopharm website at https://expopharm.de, without being able to guarantee the completeness of any official orders/measures;

b) when booking travel to and from the event, as well as any services at the event location such as accommodation, to sufficiently take into account cases of event cancellation or access restrictions due to force majeure, including pandemics, for example by agreeing an appropriate cancellation clause when booking; there is no claim for reimbursement against Avoxa - Mediengruppe Deutscher Apotheker GmbH for travel, accommodation, cancellation, or other costs incurred unless Avoxa - Mediengruppe Deutscher Apotheker GmbH or its vicarious agents and assistants act intentionally or with gross negligence, or mandatory liability exists under statutory provisions due to negligence or intent for damage to life, body, or health.

19. Final provisions:

In the event of violations of these event regulations, the site rules, or other provisions of Avoxa - Mediengruppe Deutscher Apotheker GmbH, the company is entitled to expel the person from the event. The right of expulsion may be transferred by Avoxa - Mediengruppe Deutscher Apotheker GmbH to its own employees or external service providers such as security services. Violations of the terms and conditions of participation may lead to exclusion from the current event or from participation in future events. Criminal prosecution is not excluded by the measures set out in these site rules.

20. Applicable law, place of jurisdiction

German law shall apply. The contract language is German.

If the participant is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from and in connection with the contractual relationship shall be Eschborn. This also applies in cases where the participant has no general place of jurisdiction in Germany, has moved their domicile or habitual residence abroad after conclusion of the contract, or where neither the domicile nor habitual residence of the participant is known at the time the action is brought. Regardless of this, the organizer may also assert claims against the participant at the participant's general place of jurisdiction.

21. Oral agreements, written form requirement, miscellaneous

All agreements, individual approvals, and special arrangements require written confirmation by the organizer.

Insofar as written form is required in these terms and conditions, this requirement is also met if the declarations are made by email or fax.

The organizer reserves the right to amend the terms and conditions or part thereof at any time. The current version shall apply.

Any assignment by the exhibitor of rights and obligations under the contract to a third party requires the organizer's written consent.

22. Severability clause

Should one or more provisions of these terms be or become wholly or partially invalid, the validity of the remaining provisions and of the contract shall remain unaffected. The parties shall, in good faith, conduct negotiations to replace the invalid provisions with valid provisions that come as close as possible to the economic purpose pursued by the invalid provisions. If the invalidity of a provision is based on a measure of performance or time stated therein, such as a period or deadline, the legally permissible measure closest to the provision shall replace it.

23. Data protection notice

Personal data required for the performance of the contract will be processed in accordance with the provisions of the GDPR and the BDSG. Further information on data protection can be found on the website https://expopharm.de/datenschutz.
